We Up ("we" or "us") operates an online platform (including the website and mobile application) providing services to purchase and read ebooks, buy physical books, enroll in courses, and related services (collectively, the "Services").

We are committed to protecting users' personal data. This Policy explains how we collect, process, and protect personal data and reflects We Up's compliance with applicable laws on personal data protection.

USER ACKNOWLEDGMENT

By registering an account, accessing or using We Up's Services, or carrying out any transaction on our platform, you ("you" or the "User") acknowledge that:

  • You voluntarily provide your personal data to We Up as required during registration and use of the Services.

1. LEGAL BASIS

The collection, use, processing, and protection of personal data on We Up is carried out in accordance with the laws of Vietnam, including but not limited to:

  • Decree No. 356/2025/ND-CP detailing implementation of the law on personal data protection.
  • Cybersecurity Law, Electronic Transactions Law, and related guidance.
  • Decree No. 52/2013/ND-CP and Decree No. 85/2021/ND-CP on e-commerce.

2. SCOPE OF APPLICATION

This Policy applies to all collection, use, storage, and sharing of Users' personal data in the following cases:

  • Accessing and using the We Up website/application.
  • Registering an account and logging in (including email/password or Google sign-in).
  • Purchasing and using ebooks, physical books, courses, and other related services on the platform.

3. INFORMATION (PERSONAL DATA) WE COLLECT

1. Data you provide directly

  • Identification data: Full name, email address, phone number, password (encrypted), profile photo, and other account profile information (if any).
  • Transaction data: Information related to purchases, order history, invoices, and delivery addresses (for physical books).
  • Content data: Content you create, store, or share on the platform such as comments, product/course reviews, assignments, notes, etc.

2. Data collected automatically

When you interact with the platform, we may automatically collect:

  • Device data: Device type, operating system, browser, app version, and other technical parameters.
  • Activity data: IP address, access time, pages/features viewed, reading time, learning progress, and other interactions with the system.
  • Data from cookies and similar technologies: We use cookies and similar technologies to collect information to operate and improve the user experience. We Up does not use cookies to track users for third-party advertising.

3. Data from third parties

  • Social login services: When you sign in with Google, we collect basic information (e.g., name, email, profile photo) within the scope you authorize.
  • Service partners: We may receive information from partners providing payment, cloud storage, analytics, and other technical services as necessary to operate the system.

4. PURPOSES OF PROCESSING PERSONAL DATA

We Up uses your data for the following purposes:

  • Providing and managing services: Creating, verifying, and maintaining accounts; delivering features such as reading ebooks, online learning, and purchasing physical books.
  • Processing transactions and customer support: Completing purchases, payments, invoicing, delivery; recording learning and purchase history; answering inquiries and handling issues.
  • Personalizing experience: Recommending content (books, courses) based on preferences and history; displaying information and language appropriate to your region (inferred from IP).
  • Notifications and communications: Account-related notices, transaction confirmations, service updates, recommendations, and technical support information.
  • Improving and securing services: Aggregated analysis and statistics to improve quality; detecting and preventing fraud, unauthorized access, violations of terms, and maintaining system safety and security.

5. LEGAL BASIS FOR PROCESSING AND CONSENT

  • We Up processes your personal data on one or more of the following bases: (i) your consent; (ii) performance of the service contract between you and We Up; (iii) legal obligations; and (iv) other lawful bases under applicable law.
  • You may withdraw consent at any time by contacting us. Withdrawal may affect your ability to use some or all of the Services.

6. SHARING PERSONAL DATA

We Up undertakes not to sell, lease, or trade your personal data to any third party for commercial purposes. We only share data in the following cases:

  • With service providers: Third parties that provide services to We Up such as cloud storage, payment gateways, email/SMS, and analytics tools. They may access data only as necessary to perform services and are bound by confidentiality obligations.
  • As required by law: When there is a lawful written request from a competent authority (e.g., investigation, prosecution, courts) or to protect the lawful rights and interests of We Up, other users, or the community.

  • Location: Personal data is stored on servers and cloud services meeting security standards, which may be located in Vietnam or abroad, in compliance with data protection laws.

Data will be deleted or anonymized when no longer needed for the purpose of collection or when you request deletion and conditions under law are met.

Under Vietnamese law, you have the following rights regarding your personal data:

  • The right to access, view, edit, or request correction of your data.

10. CHANGES TO THIS POLICY

  • We may amend or update this Policy at any time to reflect business needs and legal requirements.

  • Your continued use of We Up's Services after the effective date of an updated Policy constitutes acceptance of the changes.

  • Registering an account, accessing, or using any Service of We Up after the effective date confirms that you have read, understood, and agree to this Policy.

  • Changes will be published on the platform (website/application) and/or notified by email for material changes. The "Last updated" heading will be adjusted accordingly.
  • You should review this Policy regularly. Continued access or use after the updated Policy takes effect constitutes full acceptance of the changes.
  • If any provision is held invalid or unenforceable by a competent court or authority, the remaining provisions remain in full force.
  • Even if your account is terminated or you stop using the Services, We Up may retain certain personal data (e.g., transaction history, accounting records, complaint-related information) as long as necessary to comply with accounting, tax, retention laws, or to protect We Up's lawful interests within the limits of the law.
